Terms of Service

Effective date: [EFFECTIVE DATE] · Preliminary version — under review by counsel. Questions: legal@dispatchguard.ai
1. Agreement

These Terms govern your use of DispatchGuard.ai (the "Service"), operated by [ENTITY] ("DispatchGuard," "we," "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a company, you represent that you are authorized to bind that company.

2. What the Service is — and is not

DispatchGuard is an information platform. It aggregates and cross-references publicly available government records (including FMCSA registration, inspection, and enforcement data), documents submitted by users, and community-submitted reports, and presents factual signals derived from them. The Service does not provide legal, financial, insurance, or investment advice; is nota consumer reporting agency and does not furnish "consumer reports" as defined by the Fair Credit Reporting Act; and its output must not be used to determine any individual person's eligibility for credit, insurance, or employment. A favorable signal is not a guarantee of any company's conduct, and an unfavorable signal is not an accusation of wrongdoing — always verify independently before entering a transaction.

3. Accounts

You must be at least 18 and provide accurate information. You are responsible for activity on your account and for keeping credentials secure. We may suspend or terminate accounts that violate these Terms, abuse the Service, or attempt to game its data.

4. Documents you submit

When you upload or paste a document (for example a rate confirmation), you represent that you lawfully possess it and have the right to submit it. You retain ownership of your documents. You grant [ENTITY] a non-exclusive license to store, process, and analyze them to operate and improve the Service, including deriving non-identifying fraud-pattern and document-consistency signals (such as template fingerprints and payment-timing statistics) that may inform aggregate scores and checks shown to other users. The contents of your documents — including rates — are not displayed to other users. We may retain submitted documents and derived signals in accordance with the Privacy Policy, including for re-analysis as our checking systems improve.

5. Community content

Reports and reviews must be truthful, first-hand, and supported by evidence where the Service requests it. You may not submit content that is knowingly false, defamatory, retaliatory, or that discloses another person's private information. We may moderate, decline, or remove community content and may suspend accounts that abuse it. Enforcement-record entries published by the Service are limited to adjudicated facts drawn from official government records, with sources linked.

6. Acceptable use

You agree not to: scrape or bulk-extract Service data; resell or redistribute Service output without written permission; use the Service to harass or defame; probe or disrupt the Service's security; upload malware; misrepresent your identity or authority; or use automated tools to create accounts or submit documents.

7. Paid plans

Certain features may require a paid subscription. Prices are shown before purchase; taxes may apply. Subscriptions renew automatically until cancelled; you can cancel any time, effective at the end of the current billing period. [REFUND POLICY — e.g., pro-rated / no-refund / 14-day, per counsel]. We may change plan pricing with at least 30 days' notice.

8. Text messages

Text alerts are strictly opt-in, controlled per category in your notification settings, and can be stopped at any time (settings, or reply STOP). Message and data rates may apply. Consent to receive texts is never a condition of purchase. See the Privacy Policy for details.

9. Data sources and accuracy

Government data is presented as received from official sources and may contain errors or lag reality; we identify the source of material signals so you can verify them. If you believe information about your company is inaccurate, contact disputes@dispatchguard.ai — verified corrections are applied promptly.

10. Intellectual property

The Service, its design, software, scores, and derived datasets are the property of [ENTITY] or its licensors. Government records remain public records.

11. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, [ENTITY] DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, AND WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR BUSINESS DECISIONS MADE IN RELIANCE ON SERVICE OUTPUT. OUR AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12. Indemnification

You will indemnify [ENTITY] against claims arising from content you submit, your breach of these Terms, or your misuse of the Service.

13. Governing law; disputes

These Terms are governed by the laws of [STATE]. [ARBITRATION / VENUE CLAUSE — per counsel, including any class-action waiver and small-claims carve-out.]

14. Changes

We may update these Terms; material changes will be announced in the Service with at least 14 days' notice. Continued use after the effective date constitutes acceptance.
